Terms & Conditions

These terms govern your use of alphagearlab.com.au and any purchase you make from Alpha Gear Lab (ABN 33 202 833 871), a watch retailer based in Melbourne, Victoria, Australia. By using the site or placing an order, you agree to these terms. Nothing in them excludes, restricts, or modifies your rights under the Australian Consumer Law (ACL) or any other law that cannot be excluded. If a clause conflicts with a non-excludable statutory right, the statutory right applies. You can contact us at info@alphagearlab.com.au.

Pricing. All prices are shown in Australian Dollars (AUD) as the final price you pay. Standard shipping within Australia is free. Express shipping and any regional or remote Sendle surcharge are disclosed at checkout before payment. The price that applies to your order is the price displayed on the product page at the time you submit your order. We try to keep pricing accurate, but if an obvious error slips through, we may contact you to confirm the correct price or refund you in full.

Your order and when the contract forms. When you place an order, you're making an offer to buy the watch. Our confirmation email is an acknowledgement, not acceptance. A binding contract is formed when we dispatch the watch to you and send the dispatch notification email. Up until that moment we may decline or cancel your order — for example, if the watch has already sold through another channel, if we can't verify payment, if we suspect fraud, or if we made an obvious pricing error. If we do, we refund you in full.

One-of-one stock. Every watch we sell is a unique, one-of-a-kind piece. Some watches are listed on channels other than this website — most commonly Facebook Marketplace — while we work through our online queue. First to pay wins. If a watch sells through another channel before we dispatch your order, we cancel your order and refund you in full within 2 business days.

Authenticity.Our authenticity commitment, which forms part of your contract with us, is: “Every watch is a genuine brand piece — original dial, case, bracelet and movement. Small service parts (crown, stem, gaskets) may be replaced during restoration where originals are unusable. We never sell replicas, homages, or franken-watches.” Where a service-part replacement has been made during restoration, we disclose it in the listing where applicable. We are not authorised dealers for any brand and our watches are not sold as “certified pre-owned” by the manufacturer. If a watch turns out not to match this commitment, that would usually be a major failure under the Australian Consumer Law, and you would be entitled to choose a refund or replacement under section 259 of the ACL.

Condition grading. Every watch is graded on a four-point scale that forms part of its description: New / Unworn (never worn, case as-new); Excellent (minimal signs of use, near-mint under close inspection); Very Good (normal wear, light marks, all functions working); and Good (visible wear, priced to reflect condition, functionally sound). The listing for each watch states its grade and calls out any notable wear, quirks, or replaced service parts. If you're unsure about a detail, email us before ordering and we'll send extra photos or a short video.

Water resistance. Water-resistance figures shown on product pages reflect the manufacturer's original rating at the time the watch was made. Because our watches are pre-owned, seals and gaskets may have aged. Our watches are not waterproof and are not suitable for swimming, showering, diving, or other water exposure. If water resistance matters for how you plan to wear a watch, have it pressure-tested by a qualified watchmaker first. Damage caused by water exposure after delivery is not covered by our returns policy, although your consumer guarantees still apply to defects that existed at the time of sale.

Shipping.We ship within Australia only, using Sendle. Delivery timeframes are estimates — we aim to dispatch same or next business day but can't guarantee a specific delivery date. Every parcel is insured for its full purchase value, packed in a padded crush-proof box with a microfibre wrap, and sent under a discreet unbranded label. Signature on delivery is required on orders over AU$500. Sendle does not deliver to PO Boxes or AusPost Parcel Lockers, so please enter a residential or business address at checkout. Risk of loss or damage in transit stays with us until Sendle confirms the parcel has been delivered; title (ownership) in the watch passes to you when we have received full payment and delivered the watch.

Returns, refunds, and repairs. Our full returns and refunds policy is on the Returns page and forms part of these terms. In summary: because each watch is a rare, pre-owned piece, we don't accept change-of-mind returns. If your watch arrives damaged or not as described, contact us within 7 days of delivery and we'll arrange a replacement, repair, or refund — and we pay the return shipping. Your statutory rights under the Australian Consumer Law are preserved.

Your rights under the Australian Consumer Law. Our watches come with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees as to acceptable quality; fitness for a disclosed purpose; and correspondence with description, sample, or demonstration model. For a major failure — for example, a watch that is significantly different from its description, doesn't work, isn't of acceptable quality, or is unsafe — you're entitled to choose a refund or replacement of equivalent value and condition, plus compensation for any other reasonably foreseeable loss or damage. For a minor problem, we may choose to repair the watch, replace it, or refund it, whichever is quickest and fairest. If we choose to repair and the repair takes an unreasonable time, you can treat the failure as major. Acceptable quality is assessed having regard to the fact that our watches are pre-owned; disclosed wear and service-part replacements form part of the watch's described condition and are not defects. Nothing in these terms limits your rights as a consumer under the ACL or any other law that cannot be excluded.

To the maximum extent permitted by law, and subject to your ACL rights, our liability to you for any claim arising from your use of the site or a purchase from us is limited, at our option, to repairing, replacing, or refunding the relevant watch, or paying the cost of doing so. We aren't liable for indirect, consequential, special, incidental, or economic loss — such as loss of profits, business, or data — where that limit is lawful. The site is provided “as available”; we do our best to keep it running but don't guarantee it will be free of bugs, outages, or inaccuracies.

When you leave a review, you warrant it is your genuine experience and that you own the content you upload. We publish positive and negative genuine reviews. Consistent with ACCC guidance, we don't suppress reviews for being critical; we may decline or remove a review only if it is fake, unlawful, defamatory, offensive, discloses third-party personal information, or is off-topic. Our site, brand, logos, and product photography are owned by or licensed to Alpha Gear Lab. You may view and share our content for personal, non-commercial use. You may not copy, scrape, or use our content for commercial purposes — including training machine-learning systems — without our written permission. Third-party trademarks (Seiko, Citizen, Rado, Tissot, Omega, Orient, Roamer, Ricoh) remain the property of their owners; their use here is descriptive only and does not imply any endorsement, partnership, or affiliation.

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have exclusive jurisdiction, subject to any non-excludable right you may have to bring a claim elsewhere. We may update these terms from time to time; the “last updated” date at the top shows the current version. Orders already placed are governed by the version in effect when you ordered.
